Should I pay the elevator fee for living on the first floor?
According to the provisions of Article 70 of the Property Law, the owner enjoys the ownership of the exclusive part such as the residence and the operating room inside the building, and the common part outside the exclusive part enjoys the right of common ownership and joint management. Elevator and green space in the community, such as trees, belongs to all the owners, on the first floor of the residents and other floors have the same share owners, shall pay DianTiFei, and elevator service belongs to public service, not only for part of the owner to enjoy special sex, not because some people don't take the elevator, the elevator operation maintenance cost is reduced. Therefore, the first floor should be the same as other floor residents, bear the cost of elevator operation and maintenance.
And the Supreme People's Court on the concrete application of law in property service dispute cases of the interpretation of article 6 of the regulation: realty service enterprise has been in accordance with relevant provisions of the contract and related services, the owners to not only enjoy or don't need to accept the realty service for defence, the people's court shall not support.
